Notice of Determination 

Surrey, B.C. - July 13, 2023 - The Vancouver Fraser Port Authority and Transport Canada have determined that the proposed Canola Oil Transload Facility – Fraser Surrey, located at the DP World Fraser Surrey Terminal at 11060 Elevator Road, Surrey, is not likely to cause significant adverse environmental effects. 

This determination was based on a consideration of the following factors: 

  • Impacts on rights of Indigenous peoples  
  • Indigenous knowledge 
  • Community knowledge 
  • Comments received from the public 
  • Technically and economically feasible mitigation measures 

Mitigation measures taken into account for this determination are:  

  • All works will be carried out in accordance with the construction environmental management plan 
  • A qualified environmental professional will be retained to monitor works and activities  
  • An archaeological chance find procedure will be implemented in the event that archaeological resources are encountered 
  • The works will not deposit a deleterious substance in water inhabited by fish, or affect fish or fish habitat in a manner contrary to the Fisheries Act. 
  • Piles will installed using vibratory or drop hammer. Other pile installation methods are not allowed without approval from the Port Authority 
  • There will be no in-water works during the fisheries sensitive period from February 1 to June 15, inclusive 
  • Work will stop immediately if fish or fish habitat is believed to be harmed.  
  • Implementation of a "soft-start" procedure for in-water works. 
  • A side-scan sonar survey will be conducted prior to in-water works.  
  • The barge and other support vessels will be prevented from grounding on the foreshore, seabed or otherwise disturb the foreshore or seabed 
  • Nest surveys will be conducted prior to any vegetation clearing during the general bird breeding season, between April 1 and July 31, inclusive, or outside this time if occupied nests are present. Nest surveys will be conducted by a qualified professional. 
  • All activities involving the use of concrete, cement, or other lime-containing construction materials will be conducted so that the materials do not enter the aquatic environment 

The Vancouver Fraser Port Authority and Transport Canada are satisfied that the carrying out of the project is not likely to cause significant adverse environmental effects. 

Therefore, the Vancouver Fraser Port Authority and Transport Canada may carry out the project, exercise any power, perform any duty or function, or provide financial assistance to enable the project to be carried out in whole or in part.
